Introduction

This website is operated by The Camcorder Co LLC. Throughout the site, "we," "us," and "our" refer to The Camcorder Co LLC. We offer this website, including all information, tools, and services available from this site to you, the user, conditioned upon your acceptance of all terms, conditions, policies, and notices stated here.


By visiting our site and/or booking a camcorder rental, you engage in our "Service" and agree to be bound by the following Terms of Service. These Terms apply to all users of the site. Please read these Terms carefully before accessing or using our website. If you do not agree to all terms and conditions, you may not access the website or use any services.


We reserve the right to update, change, or replace any part of these Terms by posting updates to our website. Your continued use of the website following any changes constitutes acceptance of those changes.


Section 1 — Our Services

By agreeing to these Terms, you represent that you are at least the age of majority in your state or province of residence, or that you have given us your consent to allow any of your minor dependents to use this site.


The Camcorder Co LLC provides a camcorder rental and video editing service designed to help customers capture and preserve their special moments. We ship our camcorders to arrive approximately 4–6 days before your event, allowing you to record weddings, anniversaries, parties, and other celebrations. Once the event is over, you ship the camcorder back using the original box and included prepaid return label. After receiving the camcorder, we deliver all raw footage within 48 hours and a professionally edited wedding film within two weeks. A rush upgrade add-on is available at checkout for expedited delivery.


You may not use our products for any illegal or unauthorized purpose. A breach of any of the Terms will result in immediate termination of your Services.


Section 2 — Payment & Pricing

Payment for renting our camcorders is due in full at the time of booking. At checkout, you will provide your booking details including your event venue, date, shipping location, and number of camcorders needed.


We offer optional insurance coverage at checkout, which protects against loss, theft, or damage to the equipment during the rental period. If you choose not to purchase insurance, we reserve the right to place a refundable security deposit hold on your payment method on file. This hold will be released upon confirmed return of the equipment in acceptable condition. We will make reasonable efforts to notify you of any deposit hold prior to or at the time of booking.


In the event the camcorder is lost, stolen, or damaged and no insurance was purchased, you will be charged a damage fee of $250. If the cost of repair or full replacement of the equipment exceeds $250, you are responsible for the full replacement value of the equipment. Late returns will incur a fee of $35 per day. If equipment is not returned within 5 days past the due date, the full replacement cost may be charged.


Prices for our products and services are subject to change without notice.


Section 3 — Cancellation Policy

We reserve the right to cancel any order at any time prior to delivery of the camcorder, including where equipment is unavailable, payment has not been processed, or events beyond our control prevent fulfillment. In the event of our cancellation, you will be notified promptly and any payments will be refunded in full within 3–5 business days.


All payments are non-refundable. Because we commit equipment to your rental date well in advance and turn away other potential bookings, we are unable to offer refunds for customer cancellations regardless of timing.


Special circumstances such as documented medical emergencies, natural disasters, or venue closures may be considered for exceptions at our sole discretion. Please contact us at hello@thecamcorderco.com to discuss your situation. We make no guarantees regarding exceptions but will review each case individually.


Date changes must be requested at least 6 weeks before your scheduled delivery date. We will make reasonable efforts to accommodate changes, but date adjustments requested within 6 weeks of delivery cannot be guaranteed and are subject to availability.


Section 4 — Copyright & Footage Ownership

The customer retains full ownership of all footage captured using the rented camcorder. We grant the customer a non-exclusive license to use the edited video and raw footage for personal and non-commercial purposes.


The Camcorder Co LLC retains no copyright or ownership rights to the raw footage provided to the customer. However, The Camcorder Co LLC retains copyright in the edited wedding film as a creative work, and grants the customer a non-exclusive personal use license to that film.


By using our services, you automatically grant The Camcorder Co LLC a non-exclusive, worldwide, perpetual, irrevocable, royalty-free, fully paid license, with the right to sublicense, to use, reproduce, modify, adapt, edit, publish, translate, distribute, publicly perform, publicly display, and otherwise exploit footage captured on our equipment and edited videos, in whole or in part, for any lawful purpose, including without limitation operating, improving, marketing, advertising, and promoting The Camcorder Co LLC and its services, across any media now known or later developed, without additional compensation to you. We will exercise professional judgment in selecting content and will not use footage containing nudity or inappropriate material.


You may opt out of promotional use of your footage by submitting a written opt-out request to hello@thecamcorderco.com before your rental period begins. Opt-out requests submitted after footage has already been incorporated into active promotional materials will require a processing fee to be determined at the time of the request.


Section 5 — Music Licensing Disclaimer

To ensure full legal compliance, any music used in videos edited using footage from our rentals must be properly licensed for commercial use. It is the customer's sole responsibility to ensure all necessary music rights, clearances, licenses, and permissions are properly obtained prior to finalizing their video.


If any legal claims, complaints, or takedown requests are made due to unlicensed or improperly cleared music, the customer will be fully responsible for all costs, liabilities, and damages associated with responding to and resolving such claims. By finalizing your video with us, you accept full responsibility for all music included in your project.


Section 6 — Artistic Release

Lessee has spent a satisfactory amount of time reviewing our editing style and portfolio and has a reasonable expectation that we will produce the edited wedding film in a similar manner and style unless otherwise specified in writing at the time of booking.


We will use reasonable efforts to honor creative preferences communicated in advance. However, Lessee understands and agrees that:

  • Every wedding and event is unique, and footage quality and content depend on how the equipment is used by Lessee and their guests

  • Video editing is a subjective creative art, and our editors have a distinct style and aesthetic approach

  • We will use our artistic judgment when editing, which may not strictly adhere to every suggestion made after footage is received

  • Dissatisfaction with editing style, length, music selection, or pacing does not constitute grounds for a refund or re-edit beyond one complimentary revision pass

  • We reserve the right to decline requests that would require us to incorporate improperly licensed music or content that violates these Terms


Our goal is to deliver a wedding film you will treasure. If you have specific style preferences, please communicate them clearly at the time of booking.


Section 7 — The Camcorder Co Video Guarantee

The Camcorder Co LLC stands behind the quality of its equipment and service. The following guarantee governs refund eligibility:


You are eligible for a full refund of the rental and editing fee if:

  • The camcorder equipment leased by us is determined to be the direct cause of a malfunction that resulted in no usable footage, not attributable to user error, external electrical interference, or environmental factors

  • You were unable to record any video during your event despite following all setup instructions properly and the equipment was confirmed to be in working condition

  • Your package was lost in transit by the carrier and you were unable to receive any video of your event despite following all instructions properly


You are not eligible for a refund under the Video Guarantee in the following situations:

  • Failure to return equipment to us

  • Cancellation of the rental

  • Failure to complete the setup procedures provided by us via email or included in the equipment box

  • User error or damage to equipment, including: failure to use equipment at your event, failure to power on equipment, any damage or loss of equipment while in your possession, failure to properly charge batteries or use provided memory cards, or external factors beyond our control including environmental damage or electrical interference

  • Dissatisfaction with editing style, video length, or aesthetic choices


Section 8 — Exclusive Use of Equipment

The camcorder is intended exclusively for capturing footage at personal events such as weddings, anniversaries, parties, and other celebrations. The customer agrees to use the camcorder solely for these purposes and in compliance with all applicable laws. The customer is strictly prohibited from using the camcorder to record any content that is illegal, obscene, or otherwise objectionable.


Section 9 — Taxes and Duties

The Camcorder Co LLC currently does not collect sales tax on rentals. Lessee agrees to keep the equipment free of any taxes, duties, liens, or other encumbrances. In the event any taxes, duties, or other governmental charges are levied against the equipment or the rental transaction in connection with Lessee's use, Lessee agrees to be solely responsible for and to reimburse us in full for any such charges. We reserve the right to begin collecting applicable taxes and duties as required by applicable law as our business grows or as regulatory requirements change, without prior notice.


Section 10 — Accuracy of Billing and Account Information

We reserve the right to refuse any order placed with us. You agree to provide current, complete, and accurate purchase and account information for all rentals made through our website. You agree to promptly update your account and other information, including your email address and credit card details, so that we can complete your transactions and contact you as needed.


Section 11 — Accuracy, Completeness, and Timeliness of Information

We strive to ensure all information on our website is accurate and up-to-date, but we cannot guarantee accuracy at all times. Occasionally there may be typographical errors, inaccuracies, or omissions. We reserve the right to correct any such errors at any time without prior notice.


Section 12 — Third-Party Links

Third-party links on this site may direct you to websites not affiliated with us. We are not responsible for examining or evaluating the content or accuracy of any third-party websites and will have no liability or responsibility for them.


Section 13 — User Comments, Feedback and Other Submissions

If you send us testimonials, feedback, ideas, suggestions, or other materials (collectively, "comments"), you agree that we may, at any time, without restriction, edit, copy, publish, distribute, translate, and otherwise use in any medium any comments that you forward to us. You are solely responsible for any comments you make and their accuracy.

Section 15 — Prohibited Uses

In addition to other prohibitions set forth in these Terms, you are prohibited from using the site or its content: (a) for any unlawful purpose; (b) to violate any international, federal, or state regulations, rules, or laws; (c) to infringe upon or violate our intellectual property rights or the intellectual property rights of others; (d) to harass, abuse, insult, harm, defame, slander, disparage, intimidate, or discriminate; (e) to submit false or misleading information; (f) to upload or transmit viruses or any other type of malicious code; (g) to collect or track the personal information of others; or (h) to interfere with or circumvent the security features of the Service.


Section 16 — User-Generated Content License

By submitting content, footage, or video to us or capturing footage using our equipment, you grant The Camcorder Co LLC a non-exclusive, worldwide, perpetual, irrevocable, royalty-free, fully paid license, with the right to sublicense, to use, reproduce, modify, adapt, edit, publish, translate, distribute, publicly perform, publicly display, and otherwise exploit such content, in whole or in part, for any lawful purpose, including without limitation operating, improving, marketing, advertising, and promoting The Camcorder Co LLC and its services, across any media now known or later developed, including paid advertising and promotional campaigns, without additional compensation to you.


Section 17 — Liability & Indemnification

You are responsible for ensuring that the rented camcorder is not lost or damaged during your possession. If footage is lost due to a verified technical failure or negligence directly attributable to us, we will provide a refund up to the total amount paid by you for the rental and editing services. Our maximum liability in all cases is limited to the total amount you have paid us for the rental in question.


In no case shall The Camcorder Co LLC, our directors, officers, employees, affiliates, agents, contractors, interns, suppliers, service providers, or licensors be liable for any injury, loss, claim, or any indirect, incidental, punitive, special, or consequential damages of any kind.


You agree to indemnify, defend, and hold harmless The Camcorder Co LLC and our affiliates, partners, officers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers, interns, and employees from any claim or demand, including reasonable attorneys' fees, made by any third party due to or arising out of your breach of these Terms or your violation of any law or the rights of a third party.


Section 18 — Disclaimer of Warranties

The service and all products and services delivered to you are provided "as is" and "as available" for your use, without any representation, warranties, or conditions of any kind, either express or implied.


Section 19 — Force Majeure

The Camcorder Co LLC shall not be held liable for any delay or failure to perform obligations under these Terms due to causes beyond our reasonable control, including but not limited to acts of God, natural disasters, pandemics, cyber-attacks, labor disputes, government actions, or interruptions in supply chains or services.


Section 20 — Dispute Resolution & Arbitration

Any disputes arising out of or related to these Terms of Service, the Equipment Rental Agreement, or your use of our services shall be resolved through binding arbitration conducted in New Hampshire under the rules of the American Arbitration Association, except that either party may seek injunctive or other equitable relief in any court of competent jurisdiction to prevent irreparable harm. The arbitration shall take place in New Hampshire. Each party shall bear its own costs and attorneys' fees, except as otherwise provided by law or as awarded by the arbitrator. By using our services, you waive any right to a jury trial or to participate in a class action lawsuit.


Section 21 — Severability

In the event that any provision of these Terms is determined to be unlawful, void, or unenforceable, such provision shall be severed and the remaining provisions shall remain in full force.


Section 22 — Termination

These Terms are effective unless and until terminated by either you or us. If in our sole judgment you fail to comply with any term or provision of these Terms, we may terminate this agreement at any time without notice, and you will remain liable for all amounts due up to and including the date of termination.


Section 23 — Entire Agreement

These Terms of Service and any policies or operating rules posted by us on this site constitute the entire agreement and understanding between you and us and govern your use of the Service.


Section 24 — Governing Law

These Terms of Service shall be governed by and construed in accordance with the laws of the State of New Hampshire, United States.


Section 25 — Changes to Terms of Service

We reserve the right, at our sole discretion, to update, change, or replace any part of these Terms by posting updates to our website. Your continued use constitutes acceptance of those changes.
