Equipment Rental Agreement

This Equipment Rental Agreement ("Agreement") is entered into between The Camcorder Co LLC ("Lessor"), a New Hampshire limited liability company, and the customer ("Lessee").
By placing an order, submitting payment, or using our services at www.thecamcorderco.com, Lessee agrees to be bound by this Agreement, whether or not Lessee has read it. Lessor reserves the right to update or modify this Agreement at any time. Continued use of services constitutes acceptance of any updates.
1. Equipment Rental
1.1 Lease
Lessor agrees to rent camcorder equipment and related accessories ("Equipment") as specified in the order confirmation. Lessor reserves the right to refuse any order at its sole discretion. Receipt of an order confirmation does not constitute final acceptance of your order; Lessor reserves the right to accept or decline any order at any time prior to shipment.
1.2 Equipment Condition
Equipment may be previously used and may show minor cosmetic wear. Lessor warrants that all Equipment will be in working condition upon shipment and that Equipment has been fully tested and sanitized prior to delivery.
1.3 Inspection and Non-Working Equipment
Lessee must inspect Equipment within 24 hours of delivery. Any issues or damage must be reported within that timeframe. Failure to report issues within 24 hours constitutes acceptance of the Equipment as delivered.
If Equipment is confirmed defective and not due to misuse, Lessor may replace the Equipment or issue a partial or full refund at its discretion.
2. Rental Period and Shipping
2.1 Rental Term
The rental period begins on the delivery date and expires 72 hours after the Lessee's event date as stated in the order confirmation. Lessee must return-ship the Equipment to Lessor by the close of business on the first business day following the expiration of the rental period.
2.2 Delivery
Lessor will make reasonable efforts to deliver Equipment 4–6 days before the event date, with a guaranteed minimum of 48 hours before the event. Shipping carriers are third parties and delays may occur outside Lessor's control. Lessor does not guarantee specific delivery dates and does not ship on federal holidays.
2.3 Date Changes
Requests to change your event date or delivery date must be submitted to Lessor at least 6 weeks prior to the originally scheduled delivery date. Lessor will make reasonable efforts to accommodate changes but cannot guarantee availability for date changes requested within 6 weeks of the scheduled delivery date.
2.4 Returns
Lessee must return Equipment using the provided prepaid shipping label by the required return date. Lessee must retain proof of shipment until Lessor confirms receipt. Use of an unauthorized shipping label without prior approval may result in liability for loss or delays. If the return tracking information does not show the Equipment has been picked up and Lessee has no drop-off receipt, the Equipment will be considered unreturned.
2.5 Late Returns
Late returns will incur the following fees:
$35 per day for each day Equipment is returned past the due date
If Equipment is not returned within 5 days past the due date, Lessor may charge the full replacement cost of the Equipment
3. Payment, Insurance, and Security Deposit
3.1 Payment
Full payment is required at the time of booking. At checkout, Lessee will confirm rental details including event date, shipping address, number of camcorders, and whether optional insurance coverage is selected.
3.2 Insurance
Optional insurance coverage is available for purchase at checkout. Insurance covers loss, theft, or damage to the Equipment during the rental period, subject to the specific terms disclosed at checkout.
If Lessee does not purchase insurance, Lessor reserves the right to place a refundable security deposit hold on the payment method on file. The hold amount will be disclosed prior to or at the time of booking. The hold will be released upon confirmed return of Equipment in acceptable condition. If damages, loss, or unreturned Equipment are identified, Lessor may apply the deposit hold toward applicable fees.
3.3 Cancellation Policy
All payments are non-refundable. Because we commit equipment to your rental date well in advance and turn away other potential bookings, we are unable to offer refunds for customer cancellations regardless of timing.
Special circumstances such as documented medical emergencies, natural disasters, or venue closures may be reviewed at Lessor's sole discretion. Lessor may cancel any order prior to shipment and will issue a full refund within 3–5 business days.
4. Damage, Loss, and Liability
4.1 Responsibility
Lessee assumes full responsibility for Equipment during the rental period. Unless damage is reported within 24 hours of delivery, all damage is presumed to have occurred during Lessee's possession.
4.2 Damage Fee
In the event of damage, loss, or theft of the Equipment, Lessee will be charged a minimum damage fee of $250. If the cost of repair or full replacement value of the Equipment exceeds $250, Lessee is responsible for the full replacement value of the Equipment. Lessor may charge the payment method on file for all amounts owed. If the payment method cannot be successfully charged within 24 hours, Lessee shall be considered in Default.
4.3 Loss of Use Fee
In addition to repair or replacement fees, Lessor may charge Lessee a Loss of Use Fee equal to the daily rental rate for each day the Equipment is unavailable for future rentals due to damage, loss, or unreturned status. This fee compensates Lessor for lost rental income during the period the Equipment is out of service.
4.4 Loss or Theft
If Equipment is lost, stolen, or not returned, Lessee is responsible for the full replacement value. If return tracking is unavailable or invalid, Equipment will be considered unreturned and Lessee's payment method will be charged accordingly.
4.5 Collections Escalation
In the event Lessee fails to pay any amounts owed under this Agreement within 10 days of the due date, Lessor reserves the right to pursue any or all of the following remedies:
Charge the payment method on file for all amounts due
Refer the account to a third-party collections agency
Pursue civil remedies available under applicable law
File reports with relevant authorities in the case of unreturned or stolen Equipment
Lessee shall be responsible for all reasonable collection costs, including collection agency fees and reasonable attorneys' fees, incurred by Lessor in recovering amounts owed.
5. Lessee Responsibilities
Lessee agrees to:
Use Equipment properly and safely and follow all provided instructions
Return Equipment in original condition using the provided packaging
Not modify, alter, or attempt repairs
Retain proof of return shipment until Lessor confirms receipt
Lessee shall not:
Sublease or loan Equipment to any third party
Remove or obscure serial numbers or identification markings
Use Equipment for any illegal, obscene, or prohibited purpose
6. Lessor Responsibilities
Lessor will:
Provide Equipment in clean, tested, working condition
Provide setup instructions and a shot list guide
Provide a prepaid return shipping label and replacement label if lost
Provide customer support during business hours
7. Video Content, Editing, and Data
7.1 Content Ownership
Lessee retains full ownership of all raw footage captured using the Equipment. Lessor retains copyright in the edited wedding film as a creative work and grants Lessee a non-exclusive personal use license.
7.2 Promotional Use
By using our Equipment, Lessee automatically grants Lessor a non-exclusive, worldwide, perpetual, irrevocable, royalty-free license to use footage and edited videos for promotional and marketing purposes. Lessee may opt out by submitting a written request to hello@thecamcorderco.com prior to the rental period. Opt-out requests made after footage has already been incorporated into active promotional materials will require a processing fee.
7.3 Editing Turnaround and Rush Service
Raw footage will be delivered within 48 hours of Lessor receiving the returned Equipment. The completed edited wedding film will be delivered within 2 weeks of return receipt. A rush upgrade add-on is available at checkout for expedited editing delivery.
7.4 Footage Retention
Lessor will retain raw footage and edited films for 90 days following delivery of the completed edited film. After 90 days, footage will be moved to archive storage. Access to archived footage beyond 90 days is available upon request for a flat archival access fee of $100 per request, regardless of the volume of footage retrieved. This fee is payable at the time of the request.
7.5 Data Loss Disclaimer
Lessor is not responsible for lost or corrupted footage due to user error or failure to properly operate Equipment. If footage is lost due to a verified technical failure directly attributable to Lessor, Lessor will provide a refund up to the total amount paid by Lessee for the rental and editing services.
8. Artistic Release
Lessee acknowledges having reviewed Lessor's editing portfolio and has a reasonable expectation that Lessor will produce the edited wedding film in a similar style, unless otherwise specified in writing at the time of booking. Lessee understands and agrees that:
Every wedding is unique and the quality of footage depends on how the equipment is used by Lessee and their guests
Editing is a subjective creative art and Lessor's editors have a distinct aesthetic approach
Lessor will use its artistic judgment in editing and is not obligated to strictly adhere to requests received after footage has been submitted
Dissatisfaction with editing style, music selection, video length, or pacing does not constitute grounds for a refund beyond one complimentary revision pass
Lessee is not entitled to a refund based solely on subjective dissatisfaction with the aesthetic quality of the final film
9. Taxes and Duties
The Camcorder Co LLC currently does not collect sales tax on rentals. Lessee agrees to keep the Equipment free of any taxes, duties, liens, or other encumbrances. In the event any taxes or governmental charges are levied in connection with Lessee's use or possession of the Equipment, Lessee agrees to be solely responsible for and to reimburse Lessor in full for any such charges. Lessor reserves the right to begin collecting applicable taxes and duties as required by applicable law as its business grows.
10. Music Licensing
Any music included in videos edited using footage from our Equipment must be properly licensed for use by Lessee. Lessee is solely responsible for obtaining all necessary music rights, clearances, licenses, and permissions. Lessor is not responsible for any legal claims, takedown requests, or liabilities arising from unlicensed music included in Lessee's final video.
11. Limitation of Liability
Lessor shall not be liable for event disruption, missed recordings, loss of data or footage, or indirect or consequential damages. Maximum liability in all cases is limited to the total amount paid by Lessee for the rental in question.
12. Indemnification
Lessee agrees to indemnify and hold harmless The Camcorder Co LLC from any claims, damages, or liabilities arising from use of Equipment, injury or damage caused during use, or violation of this Agreement, except to the extent caused by the gross negligence or willful misconduct of Lessor.
13. Force Majeure
Lessor is not liable for delays or failure to perform due to events beyond reasonable control, including natural disasters, carrier delays, pandemics, or government actions.
14. Dispute Resolution & Arbitration
Any disputes arising out of or related to this Agreement shall be resolved through binding arbitration conducted in New Hampshire under the rules of the American Arbitration Association. The arbitration shall take place in New Hampshire. Each party shall bear its own costs and attorneys' fees, except as otherwise provided by law or awarded by the arbitrator. Lessee waives any right to participate in a class action lawsuit or jury trial with respect to any claims arising under this Agreement.
15. Governing Law
This Agreement shall be governed by the laws of the State of New Hampshire. Any disputes not subject to arbitration shall be resolved in the state or federal courts located in New Hampshire.
16. Entire Agreement
This Agreement constitutes the entire agreement between the parties and supersedes all prior communications.
17. Acceptance
By placing an order, Lessee acknowledges that they have read, understood, and agreed to this Agreement.
